Terms and conditions

How bookings, money, changes and responsibility work at Topaz Heights, Tours, and Travel Ltd. This is the version guests can read. Your invoice may add supplier rules for a specific camp.

The contract

A booking exists when we have confirmed it in writing and the deposit we asked for has arrived in the company account or through a working checkout. A website itinerary is an invitation, not a contract. Camps are subject to availability on the day we request them.

Price

Quotes are in USD or KES as stated. Park fees, taxes and airfares can move between quote and travel. We will tell you before we take the balance. We do not add a fee after you have paid and call it a surprise supplement.

Payment

Bank transfer to KCB 1278564390 or Equity 0480263456781, account name Topaz Heights, Tours, and Travel Ltd. M-Pesa and PayPal apply when those merchant accounts are connected. A deposit holds space. The balance is due on the date in your confirmation, usually before departure. Travel can be refused if the balance is open.

Changes by you

Tell us in writing. Date changes depend on the camp and the airline, not on our goodwill alone. A change can cost the supplier’s fee plus our time if the work is material. We will say the number before we do it.

Cancellation

Cancel in writing. Timeframes are counted to the first day of travel. More than 45 days out: the deposit may be retained if a supplier will not return it. 45 to 21 days: up to 50% of the land cost. Inside 21 days: up to 100%, because camps and aircraft often cannot resell the space. Travel insurance is the grown-up answer, and we will say so at booking.

Changes by us or a supplier

If a lodge closes or a flight is pulled, we offer the closest honest alternative or a refund of the money we can recover. We are not liable for a wildlife viewing that did not match a photograph, for weather, or for a river crossing that did not happen on your morning.

Your responsibility

Passports, visas and the Kenya eTA are yours to hold, even when we help with the paperwork. Health, including yellow fever where it applies, is yours. You must tell us about mobility, diet and ages of children before we confirm beds.

Conduct

A camp can refuse a guest who endangers a drive or abuses staff. That cost is not refundable. We will not ask a guide to break park rules for a closer photograph.

Liability

We organise services delivered by independent camps, airlines and drivers. We choose them carefully and we stay on the phone. We are not the insurer of the safari. Claims are limited to the amount you paid us for the service in question, except where Kenyan law does not allow that limit.

Law

These terms follow the laws of Kenya. Talk to us first at info@topaztravel.co.ke. Most problems are a camp, a car or a date, and they are solvable before they are legal.
